Terms of Use

Please read these Terms of Use (“Terms”) before using Swipni Photo Cleaner (the “App”). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Acceptance of Terms

By accessing or using Swipni Photo Cleaner, you confirm that you are at least 13 years old and legally able to agree to these Terms.

2. License

We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on an iOS device you own or control, solely for personal, non-commercial use and in accordance with these Terms.

3. Restrictions

You agree not to:

• Copy, modify, distribute, sell, or lease the App or its content.
• Reverse-engineer, decompile, or disassemble the App except where applicable law expressly permits it.
• Use the App for an unlawful purpose or in violation of applicable regulations.
• Attempt to gain unauthorized access to any part of the App or related systems.

4. In-App Purchases and Subscriptions

The App may offer optional premium features through in-app purchases or subscriptions. Apple processes App Store payments as the merchant of record.

Subscriptions automatically renew unless cancelled at least 24 hours before the current billing period ends. You can manage or cancel a subscription in Settings → Apple ID → Subscriptions. Refund requests must be directed to Apple and are subject to Apple's refund policies.

5. Important Warning — Deletion Is Permanent

Swipni Photo Cleaner helps you select photos, videos, duplicates, and other items for deletion. The App cannot recover deleted items. You are responsible for reviewing your selections before confirming deletion.

We strongly recommend keeping an appropriate backup, such as an iCloud or Finder backup, before using deletion features. To the fullest extent permitted by law, we are not liable for data loss resulting from selections you confirm in the App.

6. Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will always be uninterrupted or error-free.

7. Limitation of Liability

To the fullest extent permitted by applicable law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill, arising from your use of or inability to use the App.

8. Intellectual Property

The App's content, design, code, branding, and trademarks are owned by or licensed to us. You may not reproduce or distribute them without prior written permission.

9. Termination

We may suspend or terminate access to the App if you violate these Terms or where required by law. The license in Section 2 ends immediately upon termination.

10. Privacy

Your use of the App is also governed by our Privacy Policy, incorporated into these Terms by reference.

11. Updates and Changes

We may update, modify, or discontinue the App and may revise these Terms. Material changes will be reflected by a new “Last updated” date. Continued use after an update means you accept the revised Terms.

12. Governing Law

These Terms are governed by the laws of the Republic of Moldova, without regard to conflict-of-law principles. Disputes are subject to the jurisdiction of the competent courts of the Republic of Moldova, except where consumer law requires otherwise.

13. Apple App Store Terms

These Terms are between you and us, not Apple Inc. Apple is not responsible for the App or its content and has no obligation to provide maintenance or support.

If the App fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation.

Apple is not responsible for claims relating to the App, including product liability, regulatory compliance, or consumer protection claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
